TR> Shariah Adoption Laws: Incompatible with American Law and

    TR> | Comments (30)Yesterday's Washington Post's feature story,
TR> "Muslim orphans caught between Islam and the West;" about
TR> Muslim orphans who cannot find adoptive homes because of

    ...

TR> The reason is shariah (Islamic law), which states in
TR> unequivocal terms, "Adoption is unlawful in Islam when it
    TR> means giving a child one's own name; a share of one's
TR> estate division, and so on." [Umdat al-Salik (Reliance of
TR> the Traveller), Book K, "Trade," section k28.4 (pg. 450).]
    ...

Islamonline.net has a fatwa online that explains the real cause
and the truth of Islamic adoption. You cannot deny the child's
parents. You can do all that is done in western adoption, except
that you must allow the child his ancestry and parentage. A
child can inherit from the family that raises him, that is
allowed. He will also inherit from his biological family if
provided for under law. That is automatic.

IOW, you could adopt a Muslim child, only you have to do it by
Islamic rules, which means he keeps his family history, and he
inherits from his biological family. You can then also leave him
an inheritance in your will. It would be the same as a permenant
    guardianship in the West.

The estate division in the Reliance of the Traveler reference
applies to the automatic inheritance which then cuts him off
    from his ancestry.

    ...

TR> See......if this were a Catholic law being talked about
TR> here, or a Mormon or Evangelical law, You'd be hopping from
TR> one foot to the other while typing curses at everyone in
TR> Fido you despise, blaming us for it.

The laws against Sharia in the US will rebound back to Catholic
and Protestant and Jewish laws. The constitution is clear, you
can't make laws banning the free exercise of religion. And you
can't favor one religion over another. So, to outlaw Sharia in
the US you will have to ban consideration of any religious law.

Jewish courts, that already exist in this country, will be
    banned.

Hospitals run by pro-life faiths will have to perform abortions.

Adoption agencies run by faiths that won't place children with
    gays will be forced to.

    Or shut down.

TR> I expect you will remain completely uncaring about this.
TR> I saw a statement from some Islamic Imam in Egypt (I think)
    TR> which said:

    TR> "Don't blame Islam....blame terrorism."

TR> Who the fuck is he kidding? Islam *IS* terrorism!

Wahabism is terrorism. When you can say that you have something
    to say.

    ...

TR> offense deemed antithetical to Islam, orphaned children
TR> forbidden to be adopted into a home setting, and all
TR> government laws must strictly adhere to Islamic law.

Except that it's considered a blessing under Islam to take an
orphan into your home. The Quran specifically says it. The
Islamic community is responsible for seeing to it an orphan has
a home. The only rule the right wingers ignored is, the child's
ancestry, as known, must be kept. If his ancestry is not known
then he is considered of the brethern of the faith. IOW, a
Muslim whose ancestry is unknown. All the rest is the same.
