   When it comes to Kimmel, and Cobert, I am not 100% sure they would have a   
   case.  The problem with both of them, and especially Cobert, is that they   
   sometimes had problems expressing their views without using language that   
   is not supposed to be used on OTA TV.  The FCC had apparently been looking   
   the other way for several years.  I don't think the network would have much   
   of an issue building a case of Kimmel being an FCC liability if it comes to   
   that.   
      
   That said, many of the complaints to ABC about Kimmel supposedly came from   
   "citizens," so if another group of citizens complains about his suspension   
   (especially with their pocketbooks) they have that right and, if they are   
   loud enough, it just may work.
