Gore v Bush in 2000. USSC gives GWB the nod by a 5-4 vote.

What was their ruling based on?
Well, not all valid votes cast were allowed to be counted.
So the USSC said that was okay. The results would stand with
GWB ahead and everybody would call it a day.

A warehouse of paper votes was stored, and sealed, and never
allowed to be examined. The news media estimates that Gore won
the election in Florida by well over 50,000 votes. But due to
the number of valid votes cast that were not allowed to be
   counted, none of that mattered.

In any event, the USSC did not decide the election. Gore could
have simply ignored the ruling. But he decided to concede the
election after the USSC announced its vote. Why? "For the good
of the country." That was his stated reason.

At no time did Gore ever say he had lost the election.
