It's roughly equal to other kinds of accidental killing. The warden
didn't deliberatly kill the man with premeditation and intent, first
degree. Neither did he get angry and commit a crime of passion, 2nd
degree. But the man died through his malfeasance and dereliction of his
absolute duty, like driving a car out of control while drunk, 3rd degree.
If an inmate is beaten or raped the warden would be guilty of crime
similar to an accidental car crash resulting in serious injury, some
lesser felony crime.
The warden has an absolute duty to protect every single man in his care.
He MUST protect every inmate. His failure to do so is a serious crime.
